NJ State Trucking Laws
The Federal Motor Carrier Safety Administration regulates all commercial motor vehicles engaging in interstate traffic, while the state of New Jersey governs commercial intrastate traffic. The New Jersey Department of Public Safety has adopted Title 49 of The Federal Motor Carrier Safety Administration’s regulations, parts 382-384 and 390-399, to apply to commercial motor vehicles traveling within the state of New Jersey.
Changes to NJ Driver Qualification:
NJ has adopted part of CFR 391, with the following exceptions:
- The age requirement for a commercial truck driver carrying non-hazardous materials is 18 years old. Otherwise, commercial truck drivers must be at least 21 years old.
- A driver carrying non-hazardous materials requiring a placard who is not physically qualified (CFR 391.41) may continue to drive if he has a valid New Jersey CDL.
Vehicle Marking and Identification:
Commercial vehicles used on the streets in New Jersey must place the name of the owner or lessee and the name of the municipality in which the owner or lessee has his place of business clearly displayed on the exterior of the truck.
